The Boston Marathon bomber is getting set for a trial on the supreme court to not get the death penalty. (CNN)The Supreme Court on Monday agreed to review a lower court opinion that wiped away the death sentence of Dzhokhar Tsarnaev, one of the brothers convicted in the 2013 Boston Marathon bombing, that killed three spectators and injured hundreds.

“It may be that the legal issue, about just how carefully district court should be held accountable for his actions, in capital cases have to screen prospective jurors, is one that the current Justice Department wants the justices to clarify even if it has no intention of carrying out a potential death sentence down the road,” said Stephen Vladeck, a CNN legal analyst.

They will be reviewing his case because they believe his brother planned it, but they were both seen with the bombs and he still killed people. 

 They injured over 260 innocent people and ruined their lives. These men did very horrific things and caught everyone off guard. I don’t believe that they should even review this case, and it should stand as is.
